Work related Duty of Care

Fleet Managers who feel they need an uncomplicated package of services to enable them to comply with their responsibilities and legal obligations in relation to Driving at Work.

Today, the need for a corporate road safety policy is paramount. There are 3 million company car drivers and a further 5 million drivers who carry out work-related journeys in their private cars - 10 of these people die every day on our roads. Recent revisions to the corporate manslaughter legislation, which makes company Directors and other employees personally responsible (if negligence can be proved), have helped drive this issue up the corporate agenda.

Some employers believe, incorrectly, that provided they comply with certain road traffic law requirements e.g. valid driving licence, insurance and MOT, that this is enough to ensure the safety of their employees and others when they are on the road. This is a total misconception. Employers now have both moral and legal obligations to ensure the safety of their drivers.

If a person is driving on behalf of your business, they are classed as being 'at work'. You, and the employee have a 'duty of care'. In order to comply with that 'duty of care' you will require a Work Related Road Safety Policy and safe system of work

Work related duty of care consultation from Xcel driver training incorporates the following steps :


Step 1 : A review of your current procedures.

Our Motor Fleet Risk Manager will visit your organisation to review your current procedures with regard to road safety. The in-depth information and feedback report you receive will allow you to create, or update your policies and procedures to comply with the Health & Safety Executive's Guidelines on Work Related Road Safety.

Step 2 : Risk assessments of your drivers, and if appropriate, defensive driver training for those identified as High Risk or those who achieve 70% or less in any area of the assessment.

Xcel Roadmarque is our On-line Driver Management tool. We can provide you with a suite of on-line PC based packages that will allow you to quickly and easily risk assess your drivers, and provide training to those requiring it. Xcel Roadmarque will carry out all those laborious administrative tasks that you need to do to keep on top of your fleet and keep a complete audit trail of driver activity. For example it will alert you if a driver has gained penalty points that may disqualify them from driving - it will even carry out the administrative burden of licence verification for you.

Step 3 : The provision of on-road training sessions for those who are high risk

All our trainers are on the DSA ADI register at either Grade 5 or 6 and have a wealth of experience in fleet driver training.

Xcel's work related duty of care consultation is based on providing services for

  • Providing practical training for those drivers that achieve a high risk after taking part in the on-line driver risk assessment package. Based on a 1:1 3.5 hours on road training. Our experience shows that on average 40% of drivers achieve a high risk.
